Development of 178 Devonshire Place

The following redevelopment at 178 Devonshire Place (off of Kirkwood) is going to the Committee of Adjustment on March 7, 2012. The applicant is seeking to severe a single lot (178 Devonshire) into two separate lots (180 and 182 Devonshire), demolish the existing house and construct a 2-storey semi-detached dwelling. The property backs on to the parking lot of the seniors building on Kirkwood Avenue.

The applicant had previously gone to the Committee of Adjustment in February 2010 to severe the lot and build two 3-storey semi-detached dwellings. Several of the residents of Devonshire Place and the Hampton Iona Community Group opposed the previous request noting that the proposed buildings would be too tall for the street and out of place given the narrowness of the street. We had also noted that while there were semi-detached dwellings in close proximity to the 178 Devonshire Place, those dwellings were two stories. The Committee of Adjustment turned down the original request as they did not believe that the 3-storey proposal was keeping in the character of the street.

The current proposal is requesting approval for the following minor variances for both proposed properties at 180 and 182 Devonshire Place:

  • To permit reduced rear yard setbacks of 4.07 metres, where the bylaw requires 5.05 metres (20% reduction);
  • To permit a reduced rear yard lot area of 34.96 m2, where the bylaw requires 43.23 metres (19% reduction);
  • To permit a reduced front year setback of 4.98 m, where the bylaw requires a minimum setback of 6 m (17% reduction);
  • To permit a reduced lot area of approximately 173 m2, where the bylaw requires a minimum lot size of 180 m2 (4% reduction); and
  • To permit a reduced side yard setback of 0.94 m, where the bylaw requires 1.2 m (12% reduction).

The public is entitled to attend the Committee of Adjustment meeting which will take place on March at 3:00 pm at Ben Franklin Place, The Chamber, 101 Centrepointe Drive.
