566a Hilson Avenue/148 Clare Street (Committee of Adjustment application)

The community group has been notified by the Committee of Adjustment (CoA) that the attached application with respect to the property at the southwest corner of Hilson Avenue and Clare Street is going to the CoA on August 7, 2013.  Currently there are already two older houses on this lot, one facing Hilson Avenue (566a Hilson Avenue) and one facing Clare Street (148 Clare Street).   The applicant, Trevor John Hutchinson,  is applying to sever the property into two separate properties.  For this severance to be approved, a number of minor variances are required.  These are:

566a Hilson

1.       To permit a reduced corner side yard setback of 3.02 metres where the by0-law requires a minimum setback of 4.5 metres

2.       To permit a reduced rear yard setback of 4.62 metres where the bylaw requires a minimum rear yard setback of 7.5 metres

3.       To permit a reduced rear yard lot area of 13% of the lot area or 93 m2 whereas the Bylaw requires a minimum rear yard size of 25% of the lot are of 176 m2.

148 Clare Street

1.       To permit a reduced lot width of 10.06 metres whereas the By-law requires a minimum lot width of 12 metres

2.       To permit a reduced easterly side yard setback of 0.6 meters whereas the By-law requires a minimum total side yard setback of 2.4 metres with one minimum yard no less than 1.2 metres

3.       To permit an eave to project 0.2 metres of an interior side lot line whereas the by-law permits an eave to project 1.0 metres into a required yard but no closer than 0.3 metres to a lot line.

4.       To permit a covered porch to project to 0.73 metres of an interior side lot line whereas the By-law permits a covered porch to project 2.0 metres into a required yard but no closer than 1.0 metres to a lot line.

At this time, we do not know the ultimate use of the property.  If the request severance is approved, 566a Hilson will still have a very large side yard (as can be seen on Page 6 of the attachment).  At this time, however, it is not known, it there will be a future application for severance of 566a Hilson Avenue, given that it has a lot frontage of 34.75 metres and a lot size of 7.05 metres which is well above the minimum requirement for a single family home.
